Heavex Privacy Policy

1. INFORMATION WE COLLECT

For the proper functioning of the marketplace, we collect the following data:

• From the Buyer: Name or Company Name, Tax ID, shipping address, email, phone and billing data.
• From the Seller: Name or Company Name, Tax ID, business address, bank account details (for fund settlement) and contact information.
• Payment Data: Transactions are processed through Webpay/Flow/Mercado Pago. The Platform does not store credit card numbers or banking passwords.

2. PURPOSE OF DATA PROCESSING

Your data will be used exclusively to:

1. Manage sales and payment processing.
2. Facilitate product delivery (sharing Buyer data with the Seller).
3. Prevent fraud and illegal activities.
4. Send notifications on order status.
5. (Optional) Send marketing communications, provided the user has given explicit consent.

3. SHARING DATA WITH THIRD PARTIES

The User agrees that their data may be shared in the following cases:

• Seller and Buyer: Data strictly necessary to complete product delivery and issue invoice/receipt will be shared between them.
• Payment Gateways: To validate and process financial transactions.
• Legal Obligation: When required by courts, the tax authority or competent authorities in the exercise of their functions.

4. DATA SECURITY

We implement technical (SSL encryption) and organizational security measures to prevent loss, misuse or unauthorized access to information. However, the User is responsible for maintaining the confidentiality of their access password.

5. ARCO RIGHTS

Under Chilean law, every User has the right to:

• Access: Know what data we hold about them.
• Rectification: Correct inaccurate or outdated data.
• Cancellation: Request deletion of their data when it is no longer necessary for the purposes for which it was collected.
• Opposition: Object to the use of their data for specific purposes (such as advertising).

6. DATA RETENTION

We will retain personal information only for as long as necessary to fulfill the purposes described and to comply with legal obligations for commercial and tax registration in Chile.
